1. Acceptance of Terms
By downloading, installing, or using GYNStat ("the App"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree, do not use the App. You confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. Some features may require a valid professional medical license or clinical credentials.

2. About GYNStat
GYNStat is a clinical decision-support application developed by Pleyra for use by qualified healthcare professionals including gynecologists, obstetricians, midwives, and other women's health practitioners. The App provides clinical scoring tools, risk calculators, diagnostic aids, and reference guides covering obstetrics, gynecology, oncology, fertility, and related specialties.

3. License
Subject to your compliance with these Terms, Pleyra grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices you own or control, for your personal professional use only. This license does not permit you to:
- Copy, modify, or create derivative works of the App
- Distribute, sell, resell, or sublicense the App to any third party
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels
- Use the App for any unlawful purpose or in violation of applicable regulations
- Attempt to gain unauthorized access to any part of the App or its infrastructure

4. Medical and Professional Disclaimer
GYNStat is a clinical decision-support tool only. It is NOT a certified medical device. It does NOT constitute medical advice, diagnosis, or treatment. All clinical outputs — including scores, risk levels, classifications, and recommendations — are for informational and educational reference only and must be interpreted by a qualified healthcare professional.
GYNStat does not replace professional clinical judgment, formal medical education, institutional protocols, or established clinical guidelines. The clinician bears sole and full responsibility for all clinical decisions made with or without the assistance of this App. Pleyra expressly disclaims all liability for any clinical outcomes, patient harm, diagnostic errors, or treatment decisions arising from the use or misuse of GYNStat.
Users are solely responsible for verifying all outputs against current clinical guidelines (ACOG, RCOG, ESHRE, FIGO, WHO, NICE, or other applicable bodies) before applying them in patient care.

5. Free Trial
New users receive a 7-day free trial providing access to all premium features. The trial is granted once per Apple ID. Reinstalling the App does not grant an additional trial. If you have previously held an active GYNStat subscription, no free trial will be granted.

6. Subscriptions and Payments
GYNStat offers the following auto-renewable subscription plans:
- GYNStat Premium Monthly: $4.99 USD/month
- GYNStat Premium Yearly: $49.99 USD/year
Prices are listed in USD and may vary by region according to Apple's regional pricing.
Payment: Subscription fees are charged to your Apple ID at the time of purchase confirmation.
Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Renewal Charge: Your Apple ID is charged for renewal within 24 hours prior to the end of the current period at the same subscription price.
Cancellation: You may cancel at any time via iOS Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access until then.
Free Trial and Purchase: Purchasing a subscription while a free trial is active will end the unused portion of the trial immediately.
Refunds: All purchases are final. Refund requests are handled by Apple in accordance with the App Store Refund Policy. Pleyra does not process refunds directly.
Price Changes: Pleyra reserves the right to change subscription prices. You will be notified before any price change takes effect. Continued use after a price change constitutes acceptance of the new price.
Promo Codes: GYNStat supports Apple App Store promotional codes. Promo codes are subject to the applicable terms provided at the time of offer.

7. Free Features
Certain features of GYNStat are available without a subscription, including a limited set of clinical modules. The specific free modules may change over time. Premium features require an active subscription or an active free trial.

8. Patient Data and Privacy Compliance
GYNStat allows you to enter and store patient clinical data locally on your device. As the healthcare professional using the App, you are solely responsible for:
- Obtaining any required patient consent for data entry and processing
- Ensuring your use of the App complies with applicable healthcare privacy laws (including but not limited to HIPAA, GDPR, KVKK, and local regulations)
- Complying with your institution's data governance and information security policies
- Ensuring appropriate security of your device and App access
Pleyra does not transmit patient data to its servers. However, optional features such as AI Sharing and PDF Report Sharing involve user-initiated transmission of patient data to third-party services. You are solely responsible for the compliance of any such sharing.

9. AI Sharing Feature
GYNStat includes an optional feature to share a patient's clinical summary with third-party AI services (ChatGPT, Claude, Gemini, Grok). Use of this feature is entirely voluntary and user-initiated. By using this feature, you acknowledge that:
- You are transmitting potentially sensitive patient health information to a third-party AI provider
- Pleyra is not responsible for how third-party AI providers store, process, or use the submitted data
- You are solely responsible for compliance with applicable laws and professional obligations
- You should consider de-identifying or anonymizing patient data before use

10. Intellectual Property
GYNStat and all its content — including software, text, graphics, logos, icons, clinical algorithms, and design — are the exclusive property of Pleyra and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Pleyra's trademarks, trade names, or proprietary materials.

11. User Responsibilities
By using GYNStat, you agree to:
- Use the App only for its intended purpose and in compliance with applicable laws
- Maintain the confidentiality and security of your account credentials
- Not use the App in any manner that could damage, disable, or impair its functionality
- Not attempt to access any systems or data without authorization
- Promptly report any security vulnerabilities to hello@pleyra.com

12. Disclaimer of Warranties
GYNStat is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. Pleyra does not warrant that the App will be uninterrupted, error-free, or free of harmful components. Clinical reference data within the App is based on published guidelines and literature at the time of development; it may not reflect the most current evidence.

13. Limitation of Liability
To the maximum extent permitted by applicable law, Pleyra shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profit, or personal injury — arising out of or related to your use of or inability to use GYNStat, even if Pleyra has been advised of the possibility of such damages. Pleyra's total liability for any claim arising from these Terms or use of the App shall not exceed the amount you paid to Pleyra in the twelve (12) months preceding the claim.

14. Termination
Pleyra reserves the right to suspend or terminate your access to GYNStat at any time, with or without notice, if you breach these Terms or engage in conduct harmful to Pleyra, other users, or third parties. Upon termination, your license to use the App ends immediately. All provisions of these Terms that by their nature should survive termination shall survive, including medical disclaimers, intellectual property provisions, and limitation of liability.

15. Privacy
Your use of GYNStat is also governed by our Privacy Policy, available at www.pleyra.com/privacy and within the App under Settings > Privacy. By using GYNStat, you also agree to the Privacy Policy.

16. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

17. Changes to These Terms
Pleyra may update these Terms from time to time. Material changes will be communicated via an in-app notice or App update release notes. The "Last Updated" date at the top will reflect the most recent revision. Continued use of GYNStat after the effective date of updated Terms constitutes your acceptance.
